11 March 2021, 14:50Court turns down Yakutia shaman Gabyshev's appeal against having been committed to hospital
Yakutsk, March 11, Interfax - The Yakutia Supreme Court has upheld the Yakutsk City Court order, which committed to a psychiatric hospital shaman Alexander Gabyshev planning his next "march to Moscow."
"The court dismissed the appeal and upheld the Yakutsk City Court ruling. The cassation appeal will be lodged after the reasoned judgment is received," Pravozashchita Otkrytki coordinator Alexey Pryanishnikov told Interfax.
The appeal was processed by the same panel that considered Gabyshev cases in 2020, he said. The defense challenged the panel but its motion was declined.
The shaman's defense asked the court to listen to the testimony of independent psychiatrist Vladimir Kaverin, who had prepared an opinion on the medical commission's decision that Gabyshev must be committed to hospital.
"The opinion was included in materials in the proceeding, but the court declined to summon Kaverin. This is the second time our request for summoning a specialist has been declined, although we have provided his appearance in court," Pryanishnikov said.
The court disagreed with the defense's call for holding a comprehensive forensic psychiatric evaluation in another medical institution of the region. A doctor from the Yakutsk psychiatric dispensary said at the hearing, "treatment is good for patient Gabyshev."
Gabyshev said in early 2021 that his new "march to Moscow" would begin in March.
Gabyshev began an 8,000-kilometer journey to Moscow in March 2019, in order to "drive away" the president and "restore the people's power." The trek was meant to last two years.
In the fall of 2019, a criminal case based on public calls for extremism was opened against Gabyshev. He was detained several times and eventually ended his journey.
A state examination found Gabyshev insane. On May 12, 2020, he was committed to a psychiatric hospital. He stayed there until July 22.
Gabyshev was again committed to the psychiatric hospital in late January 2021. He is continuing to receive therapy. |
