Court to hear appeal against arrest of former schema-monk Sergy in Feb
Yekaterinburg, January 26, Interfax - A court will hear an appeal contesting the arrest of former schema-monk Sergy (Nikolay Romanov), who has been remanded in custody on charges of inciting suicide, in two weeks' time, lawyer Svetlana Gerasimova said.
"A court session [to review the appeal] has been set for February 8," Gerasimova said.
Meanwhile, a Telegram channel of Romanov's supporters has reported that the former schema-monk has been transferred from the Matrosskaya Tishina remand facility to another jail.
"I'm dealing with it right now. According to the preliminary information, [Romanov has been moved to] Remand Facility No.4," Gerasimova said when asked about the reasons behind Romanov's transfer, specifying where he is being held now.
This week, the Basmanny Court is due to consider complaints lodged by Romanov's lawyer that center on investigators' handling of the former schema-monk's detention at the Sredneuralsk Convent in the early hours of December 29, 2020. The court hearing into the aforementioned complaint was initially set for January 19, but was then moved to January 27.
According to data from the official website of Moscow's general jurisdiction courts, the court sessions to hear the complaints filed by Gerasimova are due to start at 10:00 a.m. and 10:30 a.m. on January 27. "Other reasons" are cited in the decision to postpone these court hearings.
These complaints focus on Romanov's interrogations as a suspect and as a defendant, Gerasimova said.
"His interrogation as a suspect took place at night," she said.
The Telegram channel of Romanov's supporters also reports his lawyers believe that the former schema-monk's right to defense was violated during his detention. Furthermore, his defense team asserts that as Romanov was being detained, investigators failed to review the lawyer's motion with regard to privileged communication between the lawyer and client and a motion requesting that a nighttime interrogation be postponed.
The former schema-monk was detained at the Sredneuralsk Convent on December 29, 2020. The same day, the Basmanny Court of Moscow remanded him in custody. He faces charges of inciting suicide, violating the right to freedom of conscience and freedom of religion, and arbitrary behavior.
Romanov was initially placed in Remand Facility No.7 of the Russian Federal Penitentiary Service's branch for Moscow and was later transferred to the Matrosskaya Tishina jail.
